How does estate planning reduce taxes?

Estate planning is an essential tool to help reduce the tax burden on your estate after your death. By setting up the right structure in advance, you can preserve more of your wealth for your heirs. 

Minimizing estate taxes through trusts

One of the most effective ways to reduce estate taxes is by creating a trust. In Delaware, you can establish a variety of trusts, such as irrevocable trusts, which remove assets from your taxable estate. This means that those assets won’t be counted toward the value of your estate when determining estate taxes. 

For instance, if you place a portion of your wealth into an irrevocable trust, it won’t be subject to Delaware’s estate tax, which can be as high as 16% for estates valued over $10.49 million.

Using Delaware’s estate tax exemption

Delaware offers a relatively high estate tax exemption compared to other states. As of 2025, the estate tax exemption in Delaware is $5.85 million. This means that estates worth less than this amount won’t be subject to estate tax. By carefully planning and organizing your assets, you can ensure that your estate remains below the threshold, thus avoiding estate taxes altogether. 

Leveraging lifetime gift exclusions

Another way to reduce the impact of taxes is by taking advantage of lifetime gift exclusions. Delaware law allows you to make tax-free gifts up to a certain value during your lifetime. In 2025, the federal gift tax exemption is $17,000 per recipient annually, and Delaware has no additional state gift tax. 

Planning for inheritance taxes

Delaware doesn’t impose an inheritance tax, which is a major benefit for those living in the state. This means that your heirs won’t have to pay tax on the assets they inherit, which can be a significant advantage compared to other states that do impose inheritance taxes. 

Effective estate planning can reduce the amount of taxes owed by your estate and ensure more wealth is passed on to your heirs. By taking advantage of Delaware’s favorable tax laws, you can minimize taxes and protect your family’s financial future.
