Several issues need attention in real estate transactions

Many Delaware residents struggle to find the piece of property that will be perfect for their needs. Even so, that could be the easiest part of the process. Several issues need attention from both the buyer and seller in real estate transactions.

If any detail is missed, it could come back to haunt the parties at some point in the future. This is why you need an attorney who understands the complexities of these transactions to help you through the process. Obtaining a clear title to the property is one of the most important parts of the transaction. Title searches, insurance and commitments are required before the transaction can be completed. If any title issues arise, it might be necessary to file a “quiet title” action.

Furthermore, any encroachments, easements and right-of-way issues need to be addressed. Purchase and sale agreements must be negotiated, and mortgages or equity lines of credit may need to be obtained. If there is a homeowner’s association in a residential transaction, any fees and contracts need to be taken care of as well, along with any development or subdivision documents.

These are just the most common issues that arise in real estate transactions here in Delaware, which is why it is important to be represented by an attorney. After doing the legwork to find the property, ensuring that all of the due diligence is done properly and the paperwork is handled correctly is paramount. The time, effort and cost to make sure things are done right will surely pay off in the end.
